Palm and Apple No Poaching Employees; Not

 

Palm's former CEO Ed Colligan apparently rejected an offer from Apple's Steve Jobs to not poach employees from each others respective companies.

Before Colligan stepped down as CEO in June, Jobs and Colligan had discussions in August of 2007 to not seek out hiring each other's employees. At the time, Apple introduced the iPhone just two months earlier right about when Palm hired Jon Rubenstein to develop new smart phones for Palm.

“Your proposal that we agree that neither company will hire the other’s employees, regardless of the individual’s desires, is not only wrong, it is likely illegal,” Colligan said.

Employees are entitled may seek employment where ever they chose, including at rival companies, as stated by Donald Russell, an antitrust lawyer.

“It’s a form of competition that is usually protected by antitrust laws that prohibit agreements that restrict competition,” said Russel.
